To the Muslim Community of New Zealand: After extensive consultation and guided by the principles of Islamic Jurisprudence (Fiqh), the undersigned scholars and organizations announce the adoption of "Imkān al-Ru'yah" (Possibility of Sighting) to determine the Islamic lunar months.

The Methodology
المنهجية المعتمدة
The new month begins if the following conditions are met at sunset on the 29th day:
- ✓ The Criteria: The moon must be born, set after the sun, be at least 5° above the horizon, and have an elongation (distance from sun) of at least 8°.
- ✓ The Region: If these conditions are met in one of these countries: New Zealand, Fiji and Pacific Islands, Australia, Indonesia, Malaysia, Singapore, or Brunei, the month begins for us.
يبدأ الشهر الهجرى الجديد في نيوزيلندا إذا تحققت الشروط التالية عند غروب شمس يوم 29 من الشهر:

To the beloved Muslim Community of New Zealand, All praise is due to Allah, the Lord of the Worlds, who created the sun and the moon and set them in precise orbits. May the peace and blessings of Allah be upon the Seal of the Prophets, Muhammad (peace be upon him), who taught us to worship with certainty, and upon his family and companions.
One of the greatest distinguishing features of our illustrious Shari'ah is that it is a law of mercy, spaciousness, and wisdom. It accommodates the varying conditions of people, the diversity of their lands, and the changing of their times and means; thus, it remains suitable for every era, bringing ease rather than hardship. As scholars have stated: 'There is no denunciation in matters of valid disagreement' (lā yunkar fī al-mukhtalaf fīh), for the door of Ijtihād is a door of mercy and breadth.
The determination of the Islamic lunar months—specifically Ramadan, Shawwal, and Dhul Hijjah—is a matter of great importance for the Muslim community. In the New Zealand context, the reliance on visual moon sighting has historically faced challenges due to atmospheric conditions and geographical isolation. While we respect the tradition of visual sighting, the realities of our location often lead to hesitation, late announcements, and avoidable strain on families, mosques, and workplaces.
Guided by the principles of Islamic Jurisprudence (Fiqh) which prioritizes Certainty (Yaqeen) and Unity (Wahdah), the undersigned scholars and organizations present this Fatwa to adopt the methodology of "Imkān al-Ru'yah" (The Possibility of Sighting). It is authenticated by reputable councils globally, including the European Council for Fatwa and Research, the Fiqh Council of North America, and the historic Istanbul Conferences for Unity of the Hijri Calendar (1978 and 2016).
إلى جاليتنا المسلمة الحبيبة في نيوزيلندا، الحمد لله رب العالمين، الذي خلق الشمس والقمر وجعل لهما منازل ومواقيت، والصلاة والسلام على خاتم الأنبياء والمرسلين، سيدنا محمد صلى الله عليه وسلم، الذي علمنا أن نعبد الله على بصيرة، وعلى آله وصحبه أجمعين.
إن من أعظم ما امتازت به شريعتُنا الغرّاء أنها شريعة رحمةٍ وسَعةٍ وحكمة؛ راعت اختلاف أحوال الناس، وتبايُن بلدانهم، وتغيّر أزمانهم ووسائلهم، فجاءت صالحةً لكل عصر، ميسِّرةً لا معسِّرة. إذ قرر العلماء القاعدة الفقهية: "لا يُنكَر في المختلف فيه"، لأن باب الاجتهاد باب رحمة وسَعة.
إن تحديد دخول الأشهر الهجرية - وخاصة رمضان وشوال وذي الحجة - مسألة ذات أهمية قصوى. وفي السياق النيوزيلندي، واجه الاعتماد على الرؤية البصرية المحلية تحديات تاريخية بسبب الأحوال الجوية (الغيوم) والعزلة الجغرافية. وبينما نحترم سنة الرؤية البصرية، فإن واقع موقعنا الجغرافي غالباً ما يؤدي إلى التردد، وتأخر الإعلانات، وإرهاق العائلات والمساجد وأماكن العمل.
واسترشاداً بأدلة وقواعد الفقه الإسلامي التي تُعلي من شأن اليقين و الوحدة، يقدم العلماء والمنظمات الموقعون أدناه هذه الفتوى لاعتماد منهجية "إمكانية الرؤية" (Imkān al-Ru'yah). تمثل هذه المنهجية تطبيقاً دقيقاً لمقاصد الشريعة في عصرنا الحديث، وقد صادقت عليها مجامع موثوقة عالمياً، بما في ذلك المجلس الأوروبي للإفتاء والبحوث، ومجمع فقهاء الشريعة بأمريكا الشمالية، ومؤتمرات توحيد التقويم الهجري في إسطنبول (1978 و2016).
First: The Sharia Foundation
أولاً: التأصيل الشرعي
The primary goal of the Sharia in this matter is to establish the start of the month with knowledge and certainty. The texts of the Quran did not restrict the method to one specific tool forever, but rather directed us towards knowledge.
الهدف الأساسي للشريعة في هذه المسألة هو تحديد بداية الشهر الهجرى بعلم ويقين. ولم تحصر نصوص القرآن والسنة الوسيلة في أداة واحدة للأبد، بل وجهتنا نحو "العلم".
Evidence from the Holy Quran | أدلة من القرآن الكريم
Allah (SWT) says: "So whoever among you witnesses the month, let him fast it." (Surah Al-Baqarah, 2:185)
Scholars, such as the great commentator Ibn Ashur, stated that "witnessing" (Shahida) encompasses the meanings of "presence" and "knowledge." Knowledge of the month can be acquired through visual sighting, but it can also be acquired—often with greater precision—through accurate Imkān al-Ru'yah.
Allah also says: "The sun and the moon [move] by precise calculation." (Surah Ar-Rahman, 55:5)
"...and determined for it phases - that you may know the number of years and account [of time]." (Surah Yunus, 10:5)
The Divine Link between Science and Scripture: Today, with the revolution in scientific discovery—where humanity has reached the moon and astronomical centers can predict solar eclipses to the exact second for thousands of years to come—the meaning of Allah's promise becomes manifest: "And you shall know its news after a while." (Surah Sad, 38:88) By fixing the month based on the knowledge of those phases and the "precise calculation" (Husban) mentioned in the Quran, we fulfill the very requirement of the verse.
يقول الله تعالى: ((فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ)) [سورة البقرة: 185]
ذكر المفسرون، مثل العلامة ابن عاشور، أن "الشهود" يتضمن معاني "الحضور" و"العلم". والعلم بدخول الشهر يمكن تحصيله بالرؤية البصرية، كما يمكن تحصيله - وغالباً بدقة أكبر - من خلال حساب إمكانية الرؤية الدقيق.
ويقول الله تعالى: ((الشَّمْسُ وَالْقَمَرُ بِحُسْبَانٍ)) [سورة الرحمن: 5]
((وَقَدَّرَهُ مَنَازِلَ لِتَعْلَمُوا عَدَدَ السِّنِينَ وَالْحِسَابَ)) [سورة يونس: 5]
الرابط الإلهي بين العلم والنص: اليوم، مع الثورة العلمية، يتجلى معنى قوله تعالى: ((وَلَتَعْلَمُنَّ نَبَأَهُ بَعْدَ حِينٍ)). فبتحديد الشهر بناءً على العلم بتلك المنازل و"الحسبان" المذكور في القرآن، نكون قد حققنا مقتضى الآية.
Evidence from the Sunnah | أدلة من السنة المطهرة
The purified Sunnah prescribed means that were accessible and practical for the Ummah at that time. These means are:
- • Visual Sighting (Ru'yah): The primary method when available.
- • Completing the Count (Ikmal al-Iddah): This applies when sighting is impossible due to clouds.
- • Estimation (at-Taqdeer): This is prescribed when sighting is impossible.
When the Companions asked the Prophet (peace be upon him) about the day that would be like a year... He said: "No... Estimate its extent [calculate it] (Uqduru lahu qadrahu)." (Narrated by Muslim). Here, "Estimate it" indicates "Calculate for it." This interpretation was adopted by major scholars such as Ibn Surayj (Shafi'i), Mutarrif ibn Abdullah (Tabi'i), Ibn Qutaybah, and others.
شرعت السنة المطهرة وسائل كانت متاحة وعملية للأمة في ذلك الوقت، وهي:
- • الرؤية البصرية: وهي الأصل عند الإمكان.
- • إكمال العدة: عند تعذر الرؤية بسبب الغيم.
- • التقدير: وهو مشروع عند تعذر الرؤية.
عن عبد الله بن عمر رضي الله عنهما أن رسول الله ﷺ قال: «لا تَصُومُوا حَتَّى تَرَوُا الْهِلَالَ، وَلَا تُفْطِرُوا حَتَّى تَرَوْهُ، فَإِنْ غُمَّ عَلَيْكُمْ، فَاقْدُرُوا لَهُ.» (رواه البخاري ومسلم). وقد فُسّر "التقدير" في هذا الحديث بمعنى "الحساب"، أي قدروه بحساب المنازل. وهذا التفسير تبناه عدد من كبار العلماء مثل الإمام ابن سريج (من الشافعية)، و مطرف بن عبد الله (من التابعين)، و ابن قتيبة.
Second: A Lineage of Scholarly Support
ثانياً: السند العلمي وتراث العلماء
This view is backed by a reputable lineage of scholars from the Salaf to the modern era, confirming it is a valid and robust Islamic opinion to revive the heritage of knowledge.
هذا الرأي ليس بدعاً من القول، بل يستند إلى سلف صالح وعلماء كبار أكدوا أنه رأي إسلامي معتبر:
A. The Early Generations (The Salaf)
أ. من السلف والتابعين
- • The Tabi'i Mutarrif ibn Abdullah (d. 95 AH): He interpreted the Prophet's command "Faqduru lahu" as a command to determine the moon's phases when cloudy.
- • Imam Ibn Surayj (d. 306 AH): He distinguished that the command to "complete the count" was for the general public, while "Faqduru lahu" was addressed to those with knowledge of Hisab.
- • Imam Ibn Qutaybah (d. 276 AH): He explicitly stated that "Faqduru lahu" means estimating via the knowledge of lunar stations (Manazil).
B. The Classical Jurists

- • Imam Taqi al-Din al-Subki (d. 756 AH): He stated: "If calculation indicates the impossibility of sighting, then the testimony of witnesses must be rejected... for calculation is decisive (Qat'i) while sighting is conjectural (Dhanni)."
- • Imam Ibn Daqiq al-Eid (d. 702 AH): He stated that "If astronomical calculation indicates that the crescent has risen above the horizon in a manner that would render it visible were it not for an obstruction—such as clouds—then this necessitates the obligation [of fasting], due to the existence of the legal cause (al-sabab al-shar'ī)."
C. The Modern Scholars

- • Sheikh Ahmad Shakir (d. 1958 AH): He argued that relying on Imkān al-Ru'yah is "more accurate and closer to the Sharia's intent" in our time.
- • Sheikh Muhammad Rashid Rida (d. 1935 AH): Stated that modern astronomy provides "certain knowledge" (Ilm Qat'i) that should be used to remove doubt.
- • Sheikh Mustafa Al-Zarqa (d. 1999 AH): A leading jurist who strongly advocated for this approach to unite the Muslims.
Third: The Criteria for New Zealand
ثالثاً: المعايير العلمية المعتمدة لنيوزيلندا
We have adopted the "Imkān al-Ru'yah" (Possibility of Sighting) method. This respects the Prophet's text by ensuring the moon is capable of being seen, while using science to verify that capability with certainty.
لقد اعتمدنا منهج "إمكانية الرؤية"، الذي يحترم النص النبوي بضمان أن القمر "قابل للرؤية"، مع استخدام العلم للتحقق من هذه القابلية بيقين.
The Parameters | المعايير العلمية
Based on the resolutions of the Istanbul Conferences, and certified by the European Council for Fatwa and Research (ECFR) and the Fiqh Council of North America (FCNA), the month begins if the following conditions are met at sunset on the 29th day:

Conjunction (Birth)

The new moon must be born before sunset.
Moonset after Sunset

The moon must set after the sun.
Minimum Altitude

The moon must be at least 5 degrees above the horizon.
Minimum Elongation
الحد الأدنى للاستطالة
The angle between the sun and moon must be at least 8 degrees.

To ensure accuracy and connect New Zealand with its immediate Muslim neighbors, we adopt a Regional Scope. If the scientific criteria above are met at ANY of the cities within New Zealand, Fiji and Pacific Islands, Australia, Indonesia, Malaysia, Singapore, or Brunei, the month begins for us.

Fourth: Why Imkān al-Ru'yah is Valid for Worship
رابعاً: لماذا تصح العبادة بإمكانية الرؤية؟
We already place our full trust in astronomical precision for Salah (prayers)—the pillar of Islam that precedes Fasting. We rely on these calculations to determine the exact minute of Fajr (Imsak) and Maghrib (Iftar). It is only logical and consistent to extend this certainty to the entry and exit of the month.
نحن نثق تماماً في الدقة الفلكية لتحديد أوقات الصلاة، وهي ركن من أركان الإسلام يسبق الصيام. ونعتمد على هذه الحسابات أيضاً لتحديد وقت الفجر للإمساك في الصيام ووقت المغرب للإفطار. فإذا كانت الأمة قد قبلت هذه الدقة الفلكية في أعظم عباداتها اليومية وهى الصلاة، فإن من الطبيعي والمتسق أن يمتد هذا الاعتماد إلى تحديد بداية الشهر ونهايته.

This Fatwa is issued to establish our worship on a foundation of Certainty (Yaqeen) and to foster Unity (Wahdah) with millions of Muslims across the world.

Validity of Fasting & Managing Differences | صحة الصيام وأدب الخلاف
We assure every Muslim that this approach is based on solid Islamic Jurisprudence. The fasting and worship of those who follow this method are valid and accepted by Allah. We also affirm that no Muslim should be condemned or pressured in this matter. Our obligation is to preserve brotherhood, avoid division, and seek the pleasure of Allah together.
نطمئن كل مسلم أن هذا النهج مبني على فقه إسلامي رصين. وصيام وعبادة من يتبع هذا المنهج صحيحة ومقبولة إن شاء الله. كما نؤكد أنه لا يجوز الإنكار على أي مسلم أو الضغط عليه في هذه المسألة. واجبنا هو الحفاظ على الأخوة، وتجنب الفرقة.

Imam Ibn Ashur (d. 1393 AH) states in Al-Tahrir wa'l-Tanwir regarding the verse 2:185: "The meaning of Shahida here is 'to be present' and 'to know'... Knowledge of the month is achieved by certainty, whether through visual sighting or established calculation."
الإمام ابن عاشور (ت 1393هـ): ذكر في تفسيره التحرير والتنوير عند تفسير الآية (2:185) أن معنى «شهد» هنا هو الحضور والعلم. وأوضح أن العلم بدخول الشهر يتحقق باليقين، سواء كان ذلك عن طريق الرؤية البصرية أو الحساب الفلكي المعتبر.

Imam Al-Nawawi (d. 676 AH) in Al-Minhaj Sharh Sahih Muslim (Vol 7, p. 266) records: "Some scholars said 'Estimate it' means to calculate it based on the positions of the moon."
الإمام النووي (ت 676هـ): ذكر في المنهاج شرح صحيح مسلم (ج7 ص266) أن طائفة من العلماء قالوا إن معنى «اقدروه» هو "حسابه وفق منازل القمر".
[3] The Precedence of Certainty over Conjecture | قاعدة: تقديم اليقين على الظن
Imam Taqi al-Din al-Subki (d. 756 AH) in his Fatawa (Vol 1, p. 209) writes: "Calculation is definitive (Qat'i), while testimony and sighting are conjectural (Dhanni). The conjectural cannot overturn the definitive... If calculation proves the impossibility of sighting, the testimony of a witness must be rejected as error or fabrication."
الإمام تقي الدين السبكي (ت 756هـ): قال في فتاواه (ج1 ص209): "الحساب قطعي، أما الشهادة والرؤية فظنية، والظني لا يعارض القطعي. فإذا دل الحساب على استحالة الرؤية وجب رد شهادة الشاهد لاحتمال الخطأ أو الوهم".

- • Istanbul Conference (2016): The "International Congress on the Union of the Hijri Calendar" attended by delegates from over 50 countries. It resolved to adopt the Imkan al-Ru'yah criteria (single/shared horizon) to unify the Ummah.
- • ECFR Resolution 3/19 (2009): The European Council for Fatwa and Research officially adopted the 5° Altitude / 8° Elongation criteria.
